Provisions for Italian participation in the Stabilisation,
Reconstruction and
Development of Balkan Countries

What is Law 84? |
It is an act that regulates the Italian participation
in the stabilisation, reconstruction and development process of the Balkan
Countries. Co-ordination of national actions with EU and multilateral
initiatives also falls within its province. |

Beneficiaries |
They shall be identified among the promoters of
co-operation projects, of promotional initiatives and of businesses
development. |

Albania, Bosnia-Herzegovina,
Bulgaria, Croatia, FYROM (Republic of Macedonia), the Republic of Serbia and the Republic of Montenegro
(former Federal Republic of Yugoslavia), Romania. |

Ministry of Foreign Affairs,
Ministry of Production Activities, Ministry of Environment, Regions,
Provinces and Communes. |

Amount of funding |
-
Eur 20,658,276 a year -
(pertaining to the Foreign Ministry) - over the 2001-2003 period,
allocated to co-operation-developing projects;
-
Eur 51,645,690 a year over the
2001-2002 period and Eur 25,000,000 for the year 2003. The Balkan Fund
is administered by both the Foreign Ministry and the Ministry of
Production Activities and grants are earmarked to businesses promotion
and development as well as to co-operation development. A reserve of Eur
7,230,397 a year is set up for projects proposed and managed by Regions
and Local Administrations (Provinces and Communes).

Eur 1,342,788 for 2001 and Eur
2,065,828 a year for 2002 and 2003 respectively for the setting up of a
fund for pollution monitoring managed by the Ministry of Environment.

Types of actions |
Development co-operation
(Ministry of Foreign Affairs - MAE):
training, technical assistance, development aid and security.
Businesses promotion and support
(Ministry of Production Activities - MAP):
information and communication, technical assistance, training, company
participations and soft loans, especially in the following sectors: energy
- environment; services and public utilities; SME development, tourism -
protection of the cultural and artistic heritage and of urban patrimony.
Decentralised co-operation
(Regions and local administrations):
training, technical assistance and other fields of action of relevant
national interest. |

Organisation |
An on-purpose Ministerial Committee
is set up to determine the use of and to appropriate the funds to the
Ministries in charge of implementation. It is chaired by the Prime
Minister and is composed of the Minister for Foreign Affairs, the Home
Minister, the Economy and Finance Minister, the Minister of Production
Activities, the Defence Minister and the Minister for EU Policies.
Tasks of the Committee:
a) Define the guidelines,
strategic directions and geographic and sectoral priorities;
b) Distribute funds between
MAE and the MAP’s Department for Businesses Internationalisation
c) Verify, ex-post, the
implementation of the policies adopted by the "administrating"
Ministries MAE and MAP and by the other bodies involved (Regions, local
administrations).
The Committee is supported by a
Technical-Operative Unit (UTO) made up of experts and of representatives
of the Ministries involved. On 5 July 2002, the Committee issued the
resolution containing the directives on the above-mentioned points a) and
b) (see point 10) |

Procedure
(MAP - Department for Businesses Internationalisation-administered funds) |
Taking into account the Ministerial
Committee’s guidelines, Decree no. 378 of 31 October 2002 has distributed
the relevant funds as follows.
-
To SIMEST which shall
grant non-interest bearing loans (for participation in international
tenders, trade-penetration programmes, pre-feasibility and feasibility
studies related to job order-winning investment, technical assistance
and staff training programmes); shall secure the beneficiaries of the
aforesaid grants loan collaterals and subsidiary guarantees (not
exceeding 80% of the financing); shall set up an independent and
distinct VENTURE CAPITAL fund (with the possibility of a capital
participation of up to 40% within a ceiling of Eur 516,462.00;
alienation within 8 years at current value).

To ICE which shall
provide technical assistance to businesses; will establish monitoring
and information centres in Italy and in Balkan area; shall
train young University graduates on internationalisation and foreign
trade processes concerning both Italian businesses and the Balkan area;
shall start up the Adriatic Feeler or analogous structures.

To INFORMEST which shall
sponsor promotional activities for and shall provide assistance to
businesses;

To FDL Servizi srl (the
Fiera del Levante limited company - Bari) which shall sponsor
promotional activities for and shall provide assistance to businesses;

To UNIONCAMERE which
will promote and finance projects presented by the Chambers of Commerce
or by related experienced and qualified bodies;
-
To FINEST SpA (Pordenone)
which shall set up an independent and distinct VENTURE CAPITAL FUND
(with the possibility of a capital participation of up to 40% within a
ceiling of Eur 516,462.00; alienation within 8 years at current value).
Only the implementation entities
under art 5 (2) letters d) e) and f) (ICE, INFORMEST, FDL Servizi,
UNIONCAMERE) of Law 84/01 are allowed to submit project proposals for
supporting and promoting businesses.
Applications submitted to the Ministry by other organisations will not
be examined unless they have been received through the implementation
entities for the fulfillment of their goals.
A share of the MAP-allocated fund
is furthermore earmarked for:

affording securities on financing
to Italian small- and medium-sized enterprises (SME) that have been
damaged by the default of payments of Yugoslav companies caused by the
1999 warfare.
Simest Spa, after resolution by the Facilitation Committee, will
issue specific circulars on the criteria and modalities to manage the
actions falling within its province. -
Setting up a MICROCREDIT fund
to support entrepreneurial initiatives and local partnerships and
co-operatives.
